These Terms of Service ("Terms") form a binding legal agreement between you and yForest LLC, a Texas limited liability company ("yForest," "we," "us," or "our"), regarding your use of the Starlene Oracle mobile application and any related services (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
Your continued use of the Service following any modification of these Terms constitutes your acceptance of the revised Terms.
You must be at least 13 years of age to use the Service. If you are between 13 and the age of legal majority in your jurisdiction (typically 18), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that a user is under 13, we will terminate their access and delete associated data.
By using the Service, you represent and warrant that you (a) meet the age requirement, (b) have the legal capacity to enter into this agreement, and (c) are not barred from using the Service under the laws of the United States or your jurisdiction of residence.
Starlene Oracle is an AI-powered personalized oracle application for iOS that generates readings using a combination of your stated birth information, signals you choose to connect (such as calendar, contacts, weather, location, and health data), and large language model technology provided by Anthropic.
Readings are generated for entertainment, reflection, and personal contemplation. They are not predictions, and they are not advice. See sections 09 and 10.
We may modify, suspend, add to, or discontinue any feature of the Service at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
The Service uses anonymous authentication. A unique identifier is created and stored on your device when you first launch the app. This identifier is not tied to any email, phone number, or external account.
You are responsible for maintaining the security of your device and for all activity that occurs under your installation of the Service. If your device is lost, stolen, or compromised, your reading history and subscription status may be inaccessible. Reinstalling the Service generates a new identifier and is treated as a new installation.
The Service offers two paid subscription tiers, both processed exclusively through the Apple App Store using your Apple ID:
Premium subscriptions include up to five (5) personalized readings per day and the ability to Ask Starlene up to ten (10) times per day, along with full reading history and ongoing personalization. Daily limits reset at midnight UTC.
Auto-renewal. Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan. You can manage your subscription and turn off auto-renewal by going to your Apple ID account settings on your device after purchase.
Price changes. We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. By continuing to use the Service after the price change takes effect, you agree to pay the modified subscription price.
All subscriptions are non-refundable. Access is granted immediately upon purchase and usage is consumed instantly. Refund requests are managed exclusively by Apple.
yForest LLC does not process refunds, partial refunds, or pro-rated credits for any reason, including but not limited to: dissatisfaction with readings, accidental purchase, forgotten cancellation, partial-period cancellation, device loss, account loss, or service modification. To request a refund, you must contact Apple directly through your Apple ID account or via reportaproblem.apple.com. Apple's decision is final and is not within our control.
You agree that you will not, and will not attempt to:
We may suspend or terminate your access at any time, with or without notice, for any actual or suspected violation of these Terms. Violations may also result in forfeiture of any active subscription without refund.
The Service allows you to provide input — including but not limited to your name, birth information, manual reflections, and questions submitted through "Ask Starlene" ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant yForest a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, store, process, transmit, and display that User Content solely for the purpose of operating, providing, securing, improving, and supporting the Service.
You represent and warrant that (a) you own or have the necessary rights to submit your User Content, (b) your User Content does not violate the rights of any third party, and (c) your User Content complies with these Terms and applicable law.
You are solely responsible for your User Content. We do not review, monitor, or pre-screen User Content, but we reserve the right to remove, refuse, or refuse to process any User Content at our sole discretion.
The Service uses generative artificial intelligence to produce readings, responses, and other output. AI-generated content can be inaccurate, incomplete, biased, contradictory, surprising, or wrong. Output may vary between sessions even with identical inputs.
All readings, oracle responses, glyph interpretations, and AI-generated text are provided for entertainment, reflection, and personal contemplation only. Readings are not predictions of future events, statements of fact, or professional advice of any kind.
You should not rely on AI-generated content from the Service for any consequential decision. You are solely responsible for any action you take or fail to take based on content generated by the Service. We make no representation or warranty regarding the accuracy, reliability, completeness, timeliness, or appropriateness of any AI-generated output.
The Service is not a substitute for professional advice. Nothing produced by the Service constitutes medical advice, mental health advice, legal advice, financial or investment advice, tax advice, relationship counseling, or guidance from any licensed professional.
If you are experiencing a medical or mental health emergency, contact emergency services or a qualified professional immediately. If you have legal, financial, or other professional questions, consult a licensed practitioner in the relevant field.
You agree that you will not interpret any reading, glyph, or response from the Service as a recommendation to take or refrain from any action concerning your health, safety, finances, relationships, employment, legal matters, or any other significant area of your life.
The Service relies on third-party platforms and providers, including but not limited to: Apple (App Store, StoreKit, iOS frameworks, HealthKit, EventKit, Contacts, CoreLocation), Anthropic (Claude API for AI processing), Google Firebase (authentication, cloud functions, hosting, and database services), and weather data providers.
Your use of those third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, content, or practices of any third-party service. Outages, failures, or changes in any third-party service may affect or interrupt the Service, and we are not liable for any resulting impact.
Your use of the Service is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights and choices. Please read it carefully. By using the Service, you consent to the data practices described in the Privacy Policy.
The Service, including its name "Starlene Oracle," the "Starlene" character and voice, all glyphs, brand marks, logos, designs, copy, prompt engineering, software code, and all original content not generated for an individual user, is owned by yForest LLC and is protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and other jurisdictions.
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial use, subject to these Terms.
You may not copy, reproduce, distribute, publicly perform, publicly display, modify, create derivative works of, or commercially exploit any portion of the Service or its content without our prior written consent. All rights not expressly granted are reserved.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless yForest LLC and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service, (b) your User Content, (c) your violation of these Terms, (d) your violation of any rights of any third party, or (e) your violation of any applicable law.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to sections 06, 09, 10, 13, 14, 15, 16, 19, 20, and 21) shall survive.
You may stop using the Service at any time. Cancelling your subscription is handled through your Apple ID account settings; uninstalling the app does not cancel an active subscription.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, may provide additional notice in the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles. Subject to Section 20 (Binding Arbitration), any judicial proceeding shall be brought exclusively in the state or federal courts located in Denton County, Texas, and you consent to the personal jurisdiction of those courts.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and yForest LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved exclusively through final and binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court if it qualifies.
The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, then in effect. The arbitration will be conducted in the English language and will take place in Denton County, Texas, or at another location mutually agreed in writing, or by telephone or video conference at the arbitrator's discretion. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to support@yforest.ai within thirty (30) days after first accepting these Terms. Your notice must include your name, the email or identifier associated with your installation, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor yForest can require the other to participate in arbitration, but the rest of these Terms (including Section 19) will continue to apply.
This arbitration agreement is governed by the Federal Arbitration Act.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, severed from these Terms. The remaining provisions shall remain in full force and effect.
No waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless in writing and signed by an authorized representative of yForest.
Assignment. You may not assign or transfer these Terms or any rights or obligations under them, by operation of law or otherwise, without our prior written consent. Any attempted assignment in violation of this section is void. We may assign these Terms freely, including in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, or third-party service outages.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and yForest LLC regarding the Service and supersede all prior or contemporaneous understandings, communications, or agreements, whether oral or written.
Apple-specific terms. If you accessed or downloaded the Service from the Apple App Store, you acknowledge and agree that: (a) these Terms are between you and yForest, not Apple; (b) Apple has no obligation to provide maintenance or support for the Service; (c) Apple is not responsible for any product warranties, claims, or product liability; (d) Apple is a third-party beneficiary of these Terms and may enforce them against you; and (e) you will comply with all applicable third-party terms when using the Service.
